The court-appointed receiver for a Massachusetts senior living center is immune from a resident’s claims that it unlawfully removed her from the facility despite allegations the receiver lied about the reason, a federal appeals court ruled.
The court that oversaw the receivership granted KCP Advisory Group LLC authority to manage the assets of the failing facility, which included removal of the residents due to unsafe conditions, the US Court of Appeals for the First Circuit said Tuesday.
