Northwestern University Defeats Biometric Suit Over Event Photos

Northwestern University and event-photography company CloudSpotter Technologies Inc. defeated a proposed class action alleging they captured and disclosed protected information of people attending events at the university in violation of the Illinois Biometric Information Privacy Act.

Lead plaintiff Matthew Hooks failed to adequately allege that “biometric identifiers” or “biometric information” within the meaning of BIPA was collected by CloudSpotter’s SpotMyPhotos photo-sharing platform used at university events, Judge Georgia N. Alexakis of the US District Court for the Northern District of Illinois said April 17.
