Northwestern University continued its fight against a long-running lawsuit targeting its retirement plan management, telling the Seventh Circuit that the US Supreme Court’s recent “narrow” decision in the case rejected only one of many grounds for dismissal.
The closely-watched case—which spurred a Supreme Court decision in January giving additional ammunition to the growing number of workers challenging their retirement plan fees—has returned to the US Court of Appeals for the Seventh Circuit. Northwestern urged the appeals court to consider whether the plan features endorsed by the plaintiffs were realistic possibilities for the school’s plans.
