A North Carolina charter school must face a lawsuit by the parents of three female students who say its rule that they wear skirts, jumpers, or “skorts” discriminates based on sex because appearance codes aren’t excluded under Title IX’s broad sweep, the Fourth Circuit ruled Monday.
So too must the Roger Bacon Academy Inc., which runs Charter Day School in Brunswick County under a separate contract directly with the school. The school is northwest of Wilmington.
