No Surprises Act Arbitration Proposal Takes Aim at Fees, Access

A proposal to make the arbitration process more efficient for No Surprises Act payment disputes was released Friday by the departments of Health and Human Services, Labor, the Treasury, and the Office of Personnel Management.

The proposed rule (RIN 0938-AV15) would reduce certain administrative fees tied to participating in an independent dispute resolution system that arbitrates clashes between medical providers and health insurers over payments. It also would clarify requirements to prove that a dispute is eligible for the IDR process.
