An immigration judge’s order denying the withholding of removal request of an immigrant who illegally re-entered the U.S. after being removed previously isn’t a final order subject to judicial review, the Second Circuit said Wednesday.
The court therefore said that it didn’t have jurisdiction to review Paresh Bhaktibhai-Patel’s appeal of the decision.
Bhaktibhai-Patel is a citizen of India who was ordered removed from the U.S. in 2010 and again on March 25, 2016. On March 8, 2019, he once again illegally re-entered the U.S. The next day, a Department of Homeland Security immigration officer reinstated the 2016 removal order.
