N.J. Restrictions on Size of Gun Magazines Upheld

A New Jersey law that restricts the size of gun magazines to 10 rounds doesn’t violate the Second Amendment, the U.S. Court of Appeals for the Third Circuit said Dec. 5.

The law is reasonably related to the state’s interest in preventing mass shootings and doesn’t overburden the right to own a gun for self-defense in the home, Judge Patty Shwartz said, applying intermediate scrutiny.

Dissenting Judge Stephanos Bibas, who was appointed by President Donald Trump, argued the majority should have applied strict scrutiny to the regulation and the state should have been required to prove the need for it. ...
