Nixing of Disability Benefits Appeal to Get Supreme Court Review

A man whose disability benefits appeal was dismissed will get to make his case at the U.S. Supreme Court.

The justices agreed Nov. 2 to hear Ricky Lee Smith’s appeal of a lower court ruling that found the Social Security Administration’s dismissal of his case wasn’t eligible for judicial review because it wasn’t a “final decision” under federal law.

Smith asked the high court to consider whether that interpretation by the U.S. Court of Appeals for the Sixth Circuit this year in Smith v. Comm’r of Soc. Sec. is correct.
