The Ninth Circuit’s chief judge pushed back against a second Donald Trump appointee’s criticism of how the federal appeals court issues stays in deportation cases.
An en banc panel of the US Court of Appeals for the Ninth Circuit on Tuesday denied a motion to stay a removal order for a Peruvian family while their case is reviewed by the court. Judge Eric Tung, who joined the court last year, said the order validated part of a three-judge panel’s earlier ruling in the case, which had also rejected the motion to stay removal.
