New Jersey’s Large Capacity Magazine Ban Survives Challenge

Gun rights advocates failed to convince the Third Circuit Tuesday that it should revisit an earlier panel opinion upholding New Jersey’s ban on large capacity magazines.

LCMs hold more than 10 bullets, and the state banned them because of their frequent use in mass shootings. The plaintiffs claimed that the ban violated the Second Amendment, the Fifth Amendment’s takings clause, and the 14th Amendment’s equal protection clause.

The district court denied the plaintiff’s request for a preliminary injunction, which the original panel upheld, saying the ban was constitutional.
