New Jersey Transit Can Face NY Suits, State Top Court Says (1)

New York’s highest court on Monday ruled that New Jersey Transit Corp. isn’t immune from lawsuits in New York and can be held liable for personal injury claims that originated in Manhattan, a case that required the court wade into “uncharted waters.”

Though the transit agency is, in some respects, beholden to the state of New Jersey, it has “significant independence from New Jersey’s control,” Judge Madeline Singas wrote. She elaborated that allowing the lawsuit against New Jersey Transit to move through the New York courts doesn’t “offend New Jersey’s sovereign dignity.”
