NCAA Gets to Void Broadcast Contract With Westwood One Radio

Westwood One Radio Networks LLC lost its Indiana appeals court bid Wednesday to stop the NCAA from voiding its broadcasting contract while litigation proceeds over Westwood’s failure to pay fees after the cancellation of the 2020 basketball tournament.

Westwood failed to establish it would suffer irreparable harm through any potential damage to its goodwill or reputation by the NCAA’s termination of the agreement, the court affirmed.

The broadcaster isn’t entitled to an injunction because it failed to show that any future damages due to loss of goodwill couldn’t be quantified to a reasonable degree of certainty, the court said.
