NBA Asks Supreme Court to Vacate Reinstated Data Sharing Suit

The National Basketball Association asked the US Supreme Court Tuesday to review a federal appeals court decision reinstating a proposed class action accusing the league of video data-sharing violations.

The US Court of Appeals for the Second Circuit’s 2024 ruling that Michael Salazar sufficiently alleged a concrete injury and that he was a “subscriber” under the 1988 federal Video Privacy Protection Act should be reversed, the NBA’s petition said. The league contends the appeals court created a circuit split (between the Second and four other circuits) and the ruling undermines the separation of powers and threatens the “modern internet economy.” ...
