Navistar Is Unable to Fully Shake Former Worker’s Overtime Suit

Navistar Inc. must face a former employee’s claims that she wasn’t properly paid for meal breaks she missed and that it didn’t properly use her shift differential to compute her overtime, a federal court said.

But Jennifer Shaw’s donning and doffing claims concerning what Navistar called “generic safety gear” were dismissed Tuesday. Judge Charles P. Kocoras of the US District Court for the Northern District of Illinois said that the dismissal was without prejudice and with leave to amend. The US Supreme Court recently refused to review an unrelated case in which Precision Drilling Corp. made the same argument.
