Navient Fails to Reverse Ruling Over Alleged Sham Robocall Suits

Student loan servicer Navient Solutions LLC lost its bid to toss a post-trial judgment in favor of a group of lawyers and debt-relief businesses, which Navient alleged conspired to lure student borrowers to file “sham lawsuits” against the company.

The defendants didn’t engage in sham litigation, and their petitioning activity is protected under the First Amendment, Senior Judge Henry F. Floyd of the US Court of Appeals for the Fourth Circuit said in a Tuesday opinion.
