NaphCare to Face Malpractice Claim Over Detainee’s Death in Jail

Prison health-care provider NaphCare Inc. must face a claim that it committed medical malpractice when it conducted the jail intake of a detainee, a federal appellate court said.

A district court in February 2022 granted NaphCare’s motion for summary judgment, saying that there were too many intervening events to determine that the provider’s actions were the proximate cause of Antonio May’s death. But in an opinion by Judge Gerald Bard Tjoflat, the US Court of Appeals for the Eleventh Circuit said Wednesday that a jury should make that decision.
