N.Y. Lawyer Suspended Over Sexual Activity with Client (1)

A New York lawyer who admitted to engaging in sexual conduct with a “matrimonial client” and who had the client sign a retainer agreement saying the fee was nonrefundable was suspended for a year on consent.

The Supreme Court of New York, Appellate Division, Third Department explained why it imposed the maximum term of suspension agreed upon by Alexander Russell Shmulsky and the state grievance commission.

The misconduct “involved a vulnerable matrimonial client who was not only emotionally compromised by the inherent nature of the representation, but was also faced with an economic disincentive to terminate the attorney-client relationship,” the ...
