N.J. Horse Racing Association May Recover for Ban on Gambling

The New Jersey Thoroughbred Horsemen’s Association Inc. may recover for losses caused by a temporary restraining order that barred it from conducting sports gambling, the Third Circuit ruled.

A federal district court wrongfully enjoined the NJTHA from conducting sports gambling on the basis that the New Jersey law authorizing it violated the federal Professional and Amateur Sports Protection Act, the U.S. Court of Appeals for the Third Circuit said Sept. 24 in a split ruling.

That was wrong because the U.S. Supreme Court in May 2018 found PASPA unconstitutional, the court said.
