Muslims’ No Fly List RFRA Suit Against Feds Can Proceed

The Religious Freedom Restoration Act allows plaintiffs to recover money damages from federal officers sued in their individual capacities for violations of the statute, the U.S. Court of Appeals for the Second Circuit held May 2.

Muslim men who were allegedly placed or kept on the “No Fly List” for refusing to gather information about Muslim communities can therefore proceed with their suit against federal agents, the court said in a decision by Judge Rosemary S. Pooler. She was joined by Chief Judge Robert Allen Katzmann and Judge Gerald E. Lynch.
