Missouri Appeals Court Block on Sex Offender Halloween Sign Law

Missouri will appeal a court decision blocking as unconstitutional the state’s requirement that sex offenders post a yard sign discouraging Halloween trick-or-treaters, according to a Friday notice.

Registered sex offenders were required to post a sign reading “No candy or treats at this residence” on Oct. 31. The law wasn’t sufficiently narrowly tailored to address the state’s interest in protecting children to survive First Amendment scrutiny as compelled speech, Judge John A. Ross of the US District Court for the Eastern District of Missouri ruled.
