The estate of a child who suffered severe birth-related injuries can collect a $2.5 million noneconomic damages award in Mississippi because the suit ended before lawmakers enacted a $500,000 cap, the state’s top court said.
Jana Bracewell, as the representative of Cameron Hill’s estate, won a medical malpractice suit against Michael Weber and his practice group before the effective date of a law limiting noneconomic damages in medical malpractice cases, the Mississippi Supreme Court said.
Noneconomic damages compensate plaintiffs for injuries that are hard to quantify, such as pain and suffering and loss of enjoyment of life.
