Minnesota Trans Sports Policy Withstands Challenge on Appeal

Minnesota high schools can continue to allow transgender students to participate on sports teams consistent with their gender identity or expression, the Eighth Circuit said Wednesday.

Female Athletes United, an organization that says it advocates for women to participate in sports, failed to show it has standing to challenge Minnesota’s policy under Title IX, Judge Raymond W. Gruender of the US Court of Appeals for the Eight Circuit said.

A lower court correctly found that Title IX only allows claims of intentional discrimination, and doesn’t authorize suits based on a disparate-impact theory, the appeals court said.
