A Minneapolis taco bar doesn’t have to face a second Americans with Disabilities Act lawsuit filed by an advocacy group and wheelchair-bound patron just 10 days after the eatery settled a previous case brought by the same group.
The U.S. Court of Appeals for the Eighth Circuit affirmed dismissal July 8 of the Midwest Disability Initiative’s suit accusing Nico’s Taco & Tequila Bar of nine ADA violations, including “discriminatory architectural barriers” such as poorly maintained ramps. MDI member Gerald Doyen, who uses a wheelchair or motor scooter to get around, was a co-plaintiff.
