Mentor Breast Implant Preemption Challenge a SCOTUS Skip

J&J unit Mentor Worldwide LLC held onto a win in breast implant litigation Monday, as two women who allege the company’s product caused numerous health problems failed to convince the U.S. Supreme Court to review a Tenth Circuit decision saying federal law blocks their claims.

Amber Brooks and Jamie Gale alleged that their MemoryGel implants had manufacturing defects, and that Mentor didn’t warn about health risks, properly conduct post-approval patient studies, or report problems after the implants were cleared for sale in 2006.
