Memphis Abortion Protester Wins on Exclusion From Private Street

Memphis, Tenn., police likely acted unconstitutionally in barring an abortion protester from a private road that had “all the trappings of a public street,” a federal appeals court ruled July 24.

Virginia Run Cove is a privately owned street that offers access to the parking lots of several businesses, including a Planned Parenthood clinic. John Brindley stood near the entrance to the clinic’s parking lot to promote an anti-abortion message. Memphis Police ordered him to relocate to a public street several hundred feet away.
