Maryland Unable to Enforce Handgun Qualification License Law (1)

The Fourth Circuit enjoined Maryland from enforcing its handgun qualification license law on Tuesday because it didn’t present a historical analogue for the law as required by the Bruen standard set by the Supreme Court in 2022.

The appeals court rejected Maryland’s two historical examples and said they weren’t analogous to the challenged law.

The license, a preliminary step in Maryland’s firearm registration process specific to handguns, required an applicant to submit fingerprints for a background investigation, complete a four-hour long safety training course, and wait for up to 30 days to get approval before continuing the process.
