Maryland Man Loses Appeal to Undo Money Laundering Convictions

A man convicted of laundering money stolen from a Maryland credit union lost his Fourth Circuit appeal on Friday.

Francis Arthur challenged, among other things, the district court’s refusal to dismiss the indictment, arguing that the pretrial removal from the US of one of his co-defendants, Kelvin Asare, violated his Fifth and Sixth Amendment rights.

But Arthur failed to make a plausible showing that Asare’s testimony would have been “material and favorable to his defense, in ways not merely cumulative to the testimony of available witness,” the US Court of Appeals for the Fourth Circuit said in the unpublished decision. ...
