Maryland Judges Dismissed From Challenge to County’s Bail System

A federal district court used the wrong reasoning when it dismissed 11 state court judges from a suit by detainees in a Maryland county, the Fourth Circuit said Wednesday.

The detainees sued Prince George’s County, Md., and its judges, asserting the county’s bail system violated their due process rights and was arbitrarily implemented, causing it to take weeks or months before they get pretrial release from the pretrial division of the department of corrections. The US District Court for the District of Maryland said that the judges and county were immune from the suit.
