American Auto Care LLC is subject to suit in Colorado for an unsolicited marketing call to a Colorado resident’s Vermont cell number because it allegedly places similar calls to Colorado numbers, the Tenth Circuit said Tuesday after applying a recent Supreme Court decision.
The U.S. Supreme Court’s decision in Ford Motor Co. v. Mont. Eighth Judicial Dist. Court came down after the district court threw out Alexander Hood’s Telephone Consumer Protection Act suit, the U.S. Court of Appeals for the Tenth Circuit said in reversing the lower court.
