The election for the U.S. House of Representatives in the Second Congressional District of Minnesota will be Nov. 3 as stipulated by federal law despite the death of a candidate, the Eighth Circuit said Friday.
Tyler Kistner, the Republican candidate, argued that the election should be postponed under state law, because Adam Weeks, the Legal Marijuana Now Party Candidate, died on Sept. 21. The Democratic-Farmer-Labor Party candidate, Angela Craig, said the election shouldn’t be enjoined because the state law is preempted by federal law.
