Malicious Prosecution Suit Fails in Case Over Heroin in Trunk

A man who was charged with possession with intent to distribute heroin in New Jersey until it was discovered that the drugs were wrongfully recovered from his trunk lost his attempt to sue for malicious prosecution in part because the termination of his case didn’t mean he was innocent, the Third Circuit ruled.
