Machine Gun Definition Upheld as Constitutional by 9th Circuit

An Arizona man’s convictions for possessing machine gun components will stand, after the Ninth Circuit Monday dismissed his argument that the statutory definition of machine gun was unconstitutionally vague.

Thomas Kuzma was charged with two U.S. Code violations after the Bureau of Alcohol, Tobacco, Firearms, and Explosives found a machine gun receiver—the part of a firearm that houses for the hammer, bolt, and firing mechanism—at his residence in Tuscon, Ariz.
