Louisiana Seeks Abortion Doctor Admitting Privileges Law Revival

Louisiana is asking the Fifth Circuit to reinstate a law requiring doctors who perform abortions in the state to have admitting privileges at local hospitals.

The US Supreme Court declared the law unconstitutional in 2020. But Dobbs v. Jackson Women’s Health Organization paved the way for Louisiana to revive the admitting privileges requirement, the state told the US Court of Appeals for the Fifth Circuit.

Dobbs overruled Roe v. Wade and Planned Parenthood of Southeastern Pennsylvania v. Casey on June 24, jettisoning the case law on which the decision striking Louisiana’s admitting privileges requirement was based, the state said.
