An undocumented Honduran immigrant must be sent back, even though he’ll likely be terrorized and tortured by the MS-13 gang, because he failed to prove conclusively that Honduran government officials condone the violence, a divided federal appeals court in New Orleans ruled Tuesday.
The U.S. Court of Appeals for the Fifth Circuit denied a petition by Sergio Luis Tabora Gutierrez, who crossed the U.S. border most recently in 2018—after several other deportations—in an attempt to flee the gang that has threatened and retaliated against him, including by shooting him three times.
