Lenovo Loses Out in Race to Courthouse Over Infringement Claims

A Lenovo US request for a declaratory judgment that it didn’t infringe Universal Connectivity Technologies’ patents has been tossed by a Delaware federal judge for failing to beat UTC to the courthouse.

Because this lawsuit was filed after UTC sued Lenovo Group Ltd. for patent infringement in a federal district court in Texas, this suit must be dismissed under the first-to-file rule, Judge Richard G. Andrews said Wednesday for the US District Court for the District of Delaware.
