Lawyers can work from home in New Jersey even if they’re not licensed there without violating any ethics rules as long as they don’t give the impression they’re available to practice law in the state.
The state’s Committee on the Unauthorized Practice of Law’s Oct. 6 opinion mirrors guidance issued by the American Bar Association in December.
It’s the latest in a string of jurisdictions that have clarified what the unauthorized practice of law means since the onset of the pandemic, when most lawyers shifted to remote work, often from states where they weren’t licensed.
