Lawyers Evade $655,000 in Discovery Abuse Sanctions for Now

Cavitch, Familo & Durkin Co. LPA and three of its attorneys convinced the Sixth Circuit on Thursday to vacate more than $655,000 in sanctions entered for discovery abuses that led to a $645 million default judgment in a case involving allegedly deceptive trade practices.

Cavitch and its lawyers, Michael Rasor, Komlavi Atsou, and Eric Weiss, were hit with $655,689 in sanctions in a lawsuit brought by KCI USA Inc. against Healthcare Essentials Inc. for an alleged fraud scheme related to KCI’s “VAC” wound therapy systems.
