Lawyer’s Civil Rights Claim Against Law Firm Falls on Deaf Ears

An Oklahoma lawyer’s civil rights claim against a law firm was properly dismissed for failure to state a claim, because he didn’t allege the firm acted under the color of state law, the Tenth Circuit said.

But Christopher Barnett’s anti-SLAPP claim against Hall Estill Hardwick Gable Golden & Nelson PC under the Oklahoma Citizens Participation Act should have been remanded to state court, the opinion by Judge Harris L. Hartz said.
