Lawyer Who Overbilled Public Defender’s Office Suspended

A West Virginia lawyer who overbilled the state public defender’s office in several areas including for travel and waiting in court was suspended for six months.

The West Virginia Supreme Court rejected a proposed 90-day suspension, saying Monday that Joshua Cain’s actions were intentional and harmed the public, and that 180 days “is an appropriate sanction.”

Cain admitted to billing for time waiting for court that he didn’t actually wait; billing for in-court time that did not actually occur; billing for non-billable administrative tasks; and overbilling for jail visits, hearings, and duplicate travel, the court said.
