Latin Kings Leader’s 28-Year Sentence for RICO Conspiracy Upheld

The 28-year sentence under the Racketeer Influenced and Corrupt Organizations Act given to a leader of the Latin Kings street gang for ordering and orchestrating an attempted murder was upheld by the Seventh Circuit.

Sentences for RICO violations are generally capped at 20 years unless the predicate act is a violation of state law, in which case the applicable state statutory maximum for that crime controls.

David Perez said that under Illinois law attempted murder carries a maximum life sentence only if the defendant personally discharged a firearm that proximately caused bodily harm.
