Flynt’s Fight Against Calif. Gambling Law Revived (Corrected)

Hustler magazine publisher and casino owner Larry Flynt convinced the Ninth Circuit to revive his lawsuit challenging a California law that prohibits cardroom licensees from owning over 1% of out-of-state gaming operations.

Judge Diarmuid F. O’Scannlain, writing for the court majority, applied the continuing harm theory to find that California’s statute of limitations for personal injury suits didn’t bar a facial challenge to the constitutionality of the gambling laws.
