Labcorp Must Face Class Action Over Test Prices, Court Says

Labcorp customers in Nevada who allege they weren’t told the price they’ll pay if their insurance company denies coverage plausibly alleged a deceptive trade practice, the Fourth Circuit said in reviving a proposed class action against the company.

The Nevada Deceptive Trade Practices Act prohibits failing to “disclose a material fact in connection with” a sale. The “list price” that a patient would have to pay if an insurance company declines to cover them is a material fact, the US Court of Appeals for the Fourth Circuit said in an unpublished, per curiam opinion.
