The Los Angeles Unified School District is exempt from heightened damages it would otherwise owe for covering up a teacher’s sexual assault of a student, which led to further assaults in California’s largest school system, a state appellate court said.
State law allows for up to treble damages in a tort action for sexual assault that occurred as a result of a cover-up, but public entities are exempt from damages imposed primarily for the sake of deterrence and punishment, the California Court of Appeal, Second District said.
