Texas High Court Limits Scope of Cell Phone Data Discovery Bids

Kuraray America Inc. won’t have to release the cell phone data of five workers because there’s no evidence the cell phone use contributed to a chemical release that injured several people, the Texas Supreme Court ruled Friday.

The justices acknowledged that the court hadn’t addressed cell phone data discovery before, and held that to be entitled to the release of cell phone data, the party seeking it must provide some evidence that cell phone use was the contributing cause of the incident.
