Justices Pass on Credit Reporting Case Despite Circuit Split (1)

The Supreme Court on Monday refused to clear up a circuit split over whether the federal government can be sued under the Fair Credit Reporting Act, a consumer law regulating the practices of credit reporting agencies.

Justices Clarence Thomas and Brett Kavanaugh dissented in the court’s decision not to hear the case involving a man who sued the Department of Education and others over an allegedly fraudulent student loan he sought to have removed from his credit report.

“Because this important question has divided the Courts of Appeals, I would grant review,” Thomas wrote.
