Justices to Decide if New Jersey Public Transit Can Be Sued (1)

The US Supreme Court agreed to consider if New Jersey’s public transit system can be held liable for accidents.

In an order on Thursday, the justices said they will review competing state court decisions on whether the state transit authority is considered an arm of the state that has sovereign immunity from lawsuits.

The Pennsylvania Supreme Court said it is and threw out a lawsuit Cedric Galette brought against it after he was involved in an accident caused by a New Jersey Transit vehicle.
