The US Supreme Court seemed likely to side with a former Texas councilwoman in her bid to sue the mayor, police chief, and an investigator for allegedly arresting her in retaliation for trying to oust the city manager.
Justices on both sides of the court’s ideological line suggested the US Court of Appeals for the Fifth Circuit had gone too far in requiring her to point to a situation exactly like hers that didn’t result in an arrest in order to claim she was retaliated against for expressing views protected by the First Amendment.
