How to Handle Disability Suit Against Hotel Divides Justices (1)

The US Supreme Court seemed divided on whether to dismiss a fight over a so-called “tester” lawsuit that a disability advocate brought against a Maine hotel she never planned to visit.

During arguments on Wednesday, several justices noted the company challenging the lawsuit no longer owns the hotel, that the information originally sought about the accessibility of its rooms has now been added to its website, and the discrimination claims against the hotel have since been dropped.

As Justice Elena Kagan put it, the case is “dead, dead, dead in all the ways that something can be dead.”
