The US Supreme Court ordered Texas’ highest criminal court to take a second look after it declined without explanation to vacate a capital conviction the state says it can no longer defend.
The court on Monday vacated an order by the Texas Court of Criminal Appeals and ordered it to reconsider a recommendation to toss the conviction of Michael Newberry in light of the state’s position.
Newberry says a Texas prosecutor denied him a fair trial nearly 30 years ago when she withheld sworn grand jury testimony from a co-defendant that would’ve undercut his conviction.
