The U.S. Supreme Court on Friday dropped an argument from its December sitting involving an allegedly discriminatory CVS mail-order drug policy.
Attorneys for CVS Pharmacy and respondents in the case asked the justices Thursday to dismiss the case in advance of the scheduled Dec. 7 argument.
In July, the justices granted a petition from CVS Pharmacy Inc. to consider overturning a U.S. Court of Appeals for the Ninth Circuit decision that allowed HIV/AIDS patients to sue the company under Obamacare’s anti-discrimination section over health-care plans mandating mail-order delivery for specialty drugs.
